Terms of Service

1. Agreement to Terms

By accessing or using Kodessium Developments ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Services Provided

Kodessium Developments provides custom software development, web application development, mobile app development, AI integration, and related consulting services. All work is performed on a project basis as outlined in individual proposals and contracts.

3. Project Workflow & Milestones

Proposal: Each project begins with a detailed proposal outlining scope, milestones, timeline, and cost.

Acceptance: Work begins only after you accept the proposal and agree to the outlined terms.

Milestones: Projects are divided into milestones. Each milestone must be accepted by you before work begins on it.

Verification: Upon completion of each milestone, it is submitted for your verification. You may approve it or request revisions.

Invoicing: An invoice is automatically generated upon your approval of each milestone. Payment is due within 7 days.

Delivery: A milestone is marked as delivered once payment is confirmed.

4. Payments

All payments are processed securely through Stripe.

Prices are quoted in USD unless otherwise agreed upon.

Invoices are due within 7 days of issuance.

Late payments may incur additional fees and may result in work being paused until payment is received.

5. Revisions & Disputes

Revisions: You may request revisions to milestone deliverables during the verification phase. The number of included revisions is outlined in your project proposal.

Disputes: If you are unsatisfied with a deliverable, you may open a dispute through your client portal. We will review the dispute and work towards a fair resolution.

Resolution: Disputes are reviewed within 5 business days. Outcomes may include additional revisions, partial refunds, or scope adjustments.

6. Intellectual Property

Upon full payment, all custom code, designs, and assets created for your project are transferred to you.

We retain the right to use non-confidential aspects of the project in our portfolio unless otherwise agreed.

Third-party libraries and frameworks used in your project are subject to their own licenses.

7. Confidentiality

We treat all project information, business data, and communications as confidential. We will not share your information with third parties without your consent, except as required by law.

8. Limitation of Liability

Kodessium Developments is not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability is limited to the amount paid for the specific milestone or service in question.

9. Termination

Either party may terminate a project with 14 days written notice. Upon termination, you will be invoiced for all completed milestones and work-in-progress at a pro-rated amount.

10. Changes to Terms

We reserve the right to update these terms at any time. Changes will be communicated via email and updated on this page. Continued use of the Service constitutes acceptance of updated terms.
